First proposal - Not acceptable - why should other cleaners from other divisions who have no relation with the Division of Station be lumped as one. It makes no sense. A nurse who works on surgeries in the operating room is not the same as the nurse in the walk in clinic.
Second proposal - Not acceptable - why should the cleaners work out of classification. Those household maintenance belong to other divisions that have no relation to the Station Division.
Third proposal - We will look into it as a possibility in the future however for that to happen we have to replace the current Section 1.6.A Management Rights with the following:
Management Rights
Without limitation upon exercise of any of their statutory powers or responsibilities, the Authorities shall exercise all normally accepted management prerogatives in operating transit facilities safely and efficiently with the advisory input from the employees.
Forth proposal - Maybe however for that to take place we have to replace the current Section 1.5 No Strike Clause with the following:
Strike Clause
During the term of this agreement there shall be a mutually approved strike, sit-down, slow-down, stoppage of work and willful abstinence in whole or in part. The decision of timing of when those above actions will take effect shall be solely that of the TWU Local 100.
I may be able to offer some insight to these proposals as I am a member of stations: Please be cognizant that these are my personal opinions and not official TWU positions.
ReplyDelete1. MTA changed terminal car cleaners supervisory responsibility from CED supervisors to Station supervisors.
That however does not mean the TWU bargaining unit for terminal car cleaners have changed. CED is still the main bargaining unit for car cleaners.
We as a Union cannot let the MTA dictate who will be the bargaining unit for who. MTA organizes how they see fit and that is their right.
Conversely Local 100 has rights too. We decide which division will represent which member.
2. In the 2009 contract the SMH title was established for cleaners. Proposal #2 is essentially the SMH program but without the $1.70 per hour pay increase.
Make no mistake, the SMH program in the 2009 contract was a major giveback to the MTA.
To allow Cleaners to have duties that skilled MOW members already do, can be seen as nothing but a giveback.
As a Union we cannot pit one division against another. Or one member against another.
3. In stations we have 2 picks per year. MTA wants us to have one pick a year, except where they think another pick is necessary.
Typical MTA Bulls*&t.
They say they have to do this to save money, but then in the same breath they say but we can call additional picks as we see fit, and essentially not save money.
Yes other titles have yearly picks, some titles have picks every two years, but I feel 2 picks a year is about right.
And what we are used to. To change this around when it is not necessary, is foolish and unnecessary.
4. Pre-packaged picks:
Right now when a SA goes to the pick they can pick what location they want to work at and what days off they wish to have.
This proposal would not allow the member to pick their RDOs.
Even more, members who would work locations while the "5 day" agent is on those RDOs would have to pick from pre-selected groups of stations with the days off built into them.
No way Jose.
Seniority and pick rights were fought for by those in Local 100 way before us and we should not give them up.
In my opinion out of the 4 proposals the MTA gave us, this one is hated most by the membership in stations.
It is pretty clear that MTA demands 3&4 are an attempt not only to subvert seniority and pick rights but a not-so-subtle attempt to get our most senior Station Agents to retire.
The MTA figures that if they can only pick once a year and likely NOT get the RDOs they want they would go out.
Not gonna work out.

ReplyDeleteActually Station does not have to entertain any of these TA proposals and there is nothing the TA can do about it on the Departmental level!
