Pay rules IV


Boost time

When pay for a straight run is computed to less than 8 hours then time is added to bring the run to 8 hours pay - this time is called boost.

Example: a run adds up to 7 hours 32 minutes - add 28 minutes boost.

Boost is always added to the end of a run (clear) but the actual clear time never changes.

Night differential is paid on boost time (during night time).

For late work you lose pay and no boost is added to run.

Night differential

Night differential is paid from 6:00 PM to 5:59 AM on weekdays and all day Saturday and Sunday.

Never pay half time on night differential.

On a weekday holiday when a Saturday or Sunday schedule is used night differential is paid as a weekday.

Night differential is paid on boost time.

Swing time

Paid in full for straight runs of 59 minutes or less

For swings of 2 hours or more - pay ½ the swing
For runs with double swings - each swing is computed separately applying three rules above

Total swing - the sum of all swings in a run
Paid swing - that part of the total swing that is paid
Swing time never computed as work time
Half time on swing only WDO - RDO

Work time = total of (report time+travel time+vehicle time+clear time)

Work time also called ‘standard’

When total work time in a run is over 8 hours - pay half-time on that part over 8 hours.
Example: work time = 8 hours 33 minutes ... pay 17 minutes half-time

When odd minutes in work time always pay extra minute half-time

Pay


Straight run - a scheduled run with a swing of 59 minutes or less
Swing run - a scheduled run with a swing of one hour or more
Extra - scheduled work six hours or less
Boost - when the pay for a straight run is less than 8 hours, the time that is added to bring it to 8 hours is called boost
Report time - time paid at the beginning of a run to report for a run and do a pre trip inspection
Pull out time - the time it takes to get from depot to terminal
Pull in time - the time it takes to get from terminal to depot
Clear time - paid at end of run for turning in trip sheet
Relief - when an employee relieves another employee at a point away from the depot
Relief at depot - regular pull in
Travel time - the time it takes to get from depot to relief point
Standard - the total work time in a run 
(report time + vehicle time+travel time+clear time)
Vehicle time - driving time in a run
(pull out+route time [including dead head] +pull in)
Headway allowance - the headway of the bus a bus operator takes to get to a relief point
Half time - premium pay in a run also in WDO’s, double ups and extras
Spread - the total time of a run from report to clear=work time+total swing
Paid swing - the paid portion of the swing - for swing runs first half

Driller


Driller (shifter, switchman, yardman) qualification - only bus operators who have passed a shifting qualification test will be allowed to pick and work shifting tricks and extras.

Test given on RDO on a voluntary basis. Run pay for the first session and second session. Any other attendance without pay.

Personnel who do not qualify cannot attend another qualifying session for six months. Personnel who have two or more preventable accidents while shifting during any 12 month period will be disqualified from shifting for 12 months.

Personnel disqualified twice cannot attend another qualification session for two years.
Personnel disqualified 3 times cannot attend another qualification session for ten years.

Shifters will receive an additional 25 cents/hour.
Shifters who also perform duties of Revenue Attendants will receive additional 50 cents/hour.

  3. no suspension for operating violations including passenger complaints in last 12 months

  1. additional 2 hours pay for each day or portion thereof when you have a student operator
  2. must be more than one round trip

  2. if ordered to report from residence you will get paid only the difference in time that it will take you to travel to and from foreign depot from your residence

Vacation


Picks of vacations:
  1. once a year at least two months prior to commencement of vacation year
  2. authority shall increase the quota of employees on vacation from an equal number of employees of the year, to 10% above that number during the weeks including May 1 to September 30th and Christmas,  New Years, Thanksgiving and Easter.

Line picks


Held when:
  1. regular schedule for that line is changed
  2. runs are added or eliminated from the schedule (more than a week)
  3. when 10% of the regular runs on the line are open (at least 2)
  4. on a line pick selection of runs must begin within 48 hours after the new schedule is placed in operation. If early runs are not available for operators who had early runs on the old schedule, they will will be put on the extra list.
  5. runs finishing before 9:00 PM - early runs
  6. runs finishing at 9:00 PM or later - late runs
  7. in depot picks at least 20 operators will pick daily
  8. when a new line is opened all runs of the new line will be put up for a depot pick within 48 hours of operation of the new line
  9. when a line is discontinued, operators will be put on the extra list and a depot pick to commence within 48 hours of discontinuance
  10. when a line is transferred from one depot to another, a depot pick to be held at the depot losing the line, prior to date of transfer, so operators holding runs on the line to be transferred may chose to be transferred with the line or remain at their old depot. At the depot that is receiving the line a depot pick of all runs is to be held not later than one week of the date of the transfer. This will include any operators that transferred with the line...in seniority order.
  11. operators cannot permanently switch runs after schedules are picked unless approved by vice president (example - assaulted operator, threatened operators). A temporary exchange not exceeding 14 days, can be arranged by approval of general superintendent.
  12. if driller (shifter) work unsatisfactory to maintenance they will be returned to depot and xlist can pick drill
  13. when Sat/Sun schedule operated on a holiday which falls on a weekday, operators who have picked runs on Sat/Sun shall work the runs picked for them on such schedule providing it is not their RDO
  14. new schedules must be posted 5 days prior to commencement of pick
  15. union must receive copy of pick no less than 20 days prior to the date set forth on schedule on which it will be posted for pick
  16. employees absent 30 days or more will not be allowed to pick

Depot picks to be held three times yearly as soon as possible after Jan 1st and before and after summer schedules.

Additional depot picks can be held when:
  1. Lines are discontinued
  2. New lines are opened
  3. Lines transferred from one depot to another
  4. A change in schedule warrants a new pick.

Random drug testing


Randoms are paid in same manner as periodic medicals.

All employees must go for random - not going is admission of guilt.

2 hours to report to medical - 3 hours to fill bottle - 2 to return to work location.

If it takes more then 2 hours to go to medical department, you must submit a letter explaining reasons.

Car provided - all day Saturday, Sunday and holidays - before 7AM and after 4 PM.

There are four types of randoms

Medicals


19A periodical medical every 2 years determined by even - odd birth years. Employee must be given at least 48 hours notice prior to medical. Periodic before or after report - additional 3:30 pay.

Swing run - report for periodic during swing - additional 3:30 pay.

Straight run - report for periodic during run - paid run pay/paid up to 3:30 straight time if clear time from medical is after clear time of run. Example run clears 1:42 PM and signed out of medical at 2:35 PM additional 53 minutes pay for periodic - no travel time pay.

Out of work (sick) 21 working days or 30 calendar days must go to medical before return to work. 60 days for any other reason (LOA etc).

Torts


TA court - operators excused all day get run pay (xlist - 8 hours). If operator works any part of his run then run pay plus additional 5 hours. TA court before or after run then additional 5 hours pay.

TA court on RDO - 12 hours pay unless one absence during week (sick, awol, LOA etc) then run pay.

Proof of attendance must be submitted. If held after 12 noon on RDO then paid meal ticket $3.

Change of address


All employees are required to have their permanent address and phone number on files. All employees are required to complete three copies of ‘Notice of Change of Address’ within one week of any change of their address or telephone number.

In addition employees are required to notify the DMV within ten (10) days of change of address.

Passes are good for individuals to whom they are issued. Lost passes must be reported immediately in writing to department including circumstances under which pass was lost. Misuse it - lose it, subject to discipline. May be issued to employees on extended leave.

Bus operators


Duties and responsibilities:
  1. Responsible for the safe operation and proper care and condition of their buses.
  2. Take every precaution for the safety of passengers and pedestrians.
  3. Be familiar with rules and regulations and see that they are properly executed.
  4. Accountable for the collection of fares.
  5. Remit all tickets (block tickets, senior citizen, half fare, etc).
  6. Do not deposit any fares in farebox, any fares or monies not deposited by passengers must be turned to the crew dispatcher.
  7. Do not tamper with seals of farebox and all farebox seals must be inspected before taking bus into service.
  8. Any violation of (e, f, g) is governed as mishandling of fares.
  9. Make relief only at designated relief points and at specified times unless otherwise instructed. Never leave bus until properly relieved or surrender bus to employee unfit for duty.
  10. Proper route and destination signs must be displayed.
  11. Keep doorways, aisles and passenger way clear.
  12. If a passenger becomes disorderly, annoying or dangerous ask him to leave bus at next designated stop upon refusal report to control.
  13. Any equipment trouble must be reported to control.
  14. Out of order farebox must be reported to control or a member of supervision at first opportunity.
  15. Be familiar with transfer privileges of the routes you operate and of intersecting routes.

Surface line dispatchers


Duties and responsibilities:
  1. Reports to superintendent of transportation
  2. In charge of the assignment of buses and bus operators, keeping accurate records of time worked by bus operators, keeping records of absent operators and maintain personal records, must see that operators are fit for duty and in proper uniform, remove any unfit for duty operator from service and report him to control.
  3. Responsible for the transmission of orders, the rerouting of buses, reporting of accidents - their distribution to various department heads, must keep a running record of delays to service and reasons for delays.
  4. Responsible for the operation of buses according to prescribed schedules, clearing blockages and restoring normal operations when delays occur, must assist in loading buses and check service and loads on buses at points designated by their supervisors.
  5. Supervise the conduct and performance of operators and report any violation of rules - ride buses, note performance of operators and correct any improper actions.

First aid kits


When using a first aid kit or stretcher notify the proper authority. The name of person treated, the article of the kit used and if the stretcher is returned to proper location must all be included.

Report must be submitted including name, pass, title of employee (if non employee - then name, age, home and business phone numbers) the manner in which the injury was sustained, how it was treated and first aid materials used.

Employee in charge of the kit is responsible for keeping it properly sealed and in good order.

Passengers unable to care for themselves


Passengers unable to care for themselves because of intoxication or any other reason must be placed in charge of a transit patrolman, other employee or city patrolman. 

Any such person should not be allowed to pay fare or enter authority vehicle.

All reports, facts names, addresses etc are confidential and must not be communicated by any employee except to the proper officials of the system or designated authorities.

Employees will receive one (1) hour pay (less boost in run) for accident report. One (1) hour only even for more than one (1) accident in a day.

Facts to be included in reports


  1. Names and addresses of witnesses (pass numbers and department if they work for Transit) shield numbers and agencies of any uniformed personnel allowed to ride with no payment of fare.
  2. Submit any information regarding an accident to your department head.
  3. Report the date, time and exact location of accident.
  4. Make note of the conditions of the area where the accident occurred and have witnesses do the same.
  5. When accidents occur on system property an immediate inspection of the area must be made and submitted.
  6. Accident reports must be made by all employees involved.
  7. If one employee turns over an injured person to another employee exchange names, titles and pass numbers and include on report.
  8. Report all disputes and disturbances.

Accidents


Accidents and unusual occurrence take every precaution to prevent accidents or injuries to persons or damage to property. The safety of passengers must receive first consideration and prompt action must be taken.

Employees to make written reports of accident and unusual occurrences - in case of accidents to persons (employee or not) damage to property or unusual occurrences all employees must whether on duty or not make written reports as soon as possible.

In case of an accident to a passenger you must secure business address and phone number as well as home address and phone number of alleged injured person or persons.

Never inform a person involved in an accident that a representative of the authority will communicate with them direct them to either write or visit the law department.

General orders, bulletins and official notices remain in effect until fulfilled, superseded or cancelled.

All must be removed within 48 hours of being fulfilled, superseded or cancelled - all must be read daily.

Lost articles


Articles found by employees or turned over to employees by passengers must be turned in at location with lost property bag at crew. Articles must be entered in lost property book and sent to lost property - 34th Street and 8th Avenue subway.

If a claim is made by someone with proper identification, property can be returned. Name, address, phone number and signature are required as well as name and pass number of employee returning lost property.

Employees must not divulge contents or description of articles.

Articles of great value must be sent to lost property ASAP.

Do not contact owner of lost property.

Rules and regulations

  3. Radioactive material or anything that might cause accidents.
  4. Long articles that project above doors.

  7. Soiled or dirty clothing in baskets or other.
  8. Fish or baskets used for carrying fish.
  9. Dogs or other animals not enclosed in animal carriers 
except:
seeing eye dog - identified by harness.
hearing dog - identified by orange collar.


Ordinary hand baggage, instrument cases, small folded baby carriages, bundles or parcels can be allowed but must be placed so as not to obstruct doors.

Employees must not be responsible for or take charge of any article except lost articles.

Family leave


Up to 12 weeks (60 days) for certain family and medical reasons and you must have worked for at least one (1) year and 1250 hours over previous 12 months.

Reasons: 
  1. Care for child after birth.
  2. Care for employees spouse, son, daughter or parent with serious health problem.
  3. Serious health condition that makes it impossible to perform employees duties.

Advance notice and certification
30 days advance notice when the leave is forseeable - may require medical certification. 
FMLA cannot result in loss of any employment benefits that accrued prior to start of an employee’s leave.

Employee must exhaust all paid leave balances (VAC, AVA, PD) when taking FMLA leave - these days are included in the 12 weeks (60 working days) maximum FMLA leave. You must not use sick leave.

Application examined at location chief and final approval given medical assessment center 4 - MAC4.

If FMLA is for your own medical reasons then you must first use sick leave then the option of vacation - AVA, PD otherwise unpaid leave of absence LOA.

Civil service test


Employees are excused with pay for promotional exams.

The following are the instances where employees are excused in all cases. You have two (2) hours to return to work location and must work the balance of your work - if any left.

Examples: 
a) If you work an AM run and the test is in the AM then do not report for run.
  1. If you work a PM run then you have two (2) hours from completion of the test to return to the work location. You must work balance of run if any.
  2. If the clearing time of your previous days work is within eight (8) hours of the start time of the test then you are excused with pay from previous days work. In example work clears at 02:01 AM and test begins at 10:00AM.

All employees must return to work location after completion of examination and turn in attendance slip.

You must have one (1) year on the job to be off with pay - otherwise available vacation allowance AVA, vacation allowed day VAD, etc.

You must have three (3) years to be eligible for promotion.

Injury on duty and compensation


First day of injury employee is carried IOD and paid run pay for balance of tour. Each day after it is compensation. Employee on compensation is paid eight (8) hours (not run pay).

First nine days on compensation is differential pay. On tenth day employee is entitled to compensation (eight (8) hours per day). Employee is paid compensation and the balance of differential pay to bring total to eight (8) hours.

On re occurrence of a previous injury there is no IOD pay - employee goes right onto compensation. Rate of pay reverts back to rate at original date of injury.

No other allowances can be paid while on compensation (holiday/vacation).

Jury


Jury duty run pay. Extra list eight (8) hours.
Extra list assigned in advance - run pay.
All checks received from the state must be turned over - within 90 days.
Fees during vacation or RDOs returned to employee.
All travel allowances returned to employee.
To qualify for jury leave of absence up to four (4) hours.
Days off changed to Saturday and Sunday. 
If birthday falls while you are on jury duty - pay holiday and keep 
jury fees for day.
Double up on jury - straight time.

Military



22 paid military days - 30 allowed counting weekends or 30 weekdays paid. Eight (8) hours pay for military. 

Holiday on scheduled workday - pay holiday - charge military one (1) day. 
Holiday on RDO - pay holiday - charge one (1) military day.
When 30 military days are used employee on military is now paid four (4) hours a day for total length of military duty.
Employees on military do not lose any time towards seniority, vacation etc.

Sick out of town


Employee is carried sick unpaid until documentation from out of town physician is turned in and approved.

Employee cannot be placed on sick leave control list (SLCL) without counseling. Bringing in doctors lines for sick absences keeps you off list. No documentation needed for absences of three (3) days or less. If you are not on (SLCL) you do not have to call out of house and are no longer subject to home visits.

No sick leave usage in a calendar year - you can cash out up to two (2) sick days. If one (1) day used - you can cash out one (1) sick day - employee option. Sick leave cash out year -November 1st thru October 31st. Cash out pay is eight (8) hours (not run pay). Must have at least 25 days sick balance as of November 1st. Must have at least 50% of max potential as adjusted for any previous sick cash out. Sick days cashed are deducted from sick balance.

Sick leave control

All on sick control list must provide medical documentation. If employee is placed on the sick control list then they will lose first day pay for sick until removed from list. 

Sick on vacation - vacation not interrupted. Sick time interrupted for scheduled vacation. Sick on holiday (less than 30 days) pay holiday (8 hours). 
Sick on holiday (more than 30 days) pay sick (run pay) deny holiday.
Sick off run on holiday - pay straight time for actual time worked plus (8) hours for holiday - medical documentation required for all sick on holiday.

Sick leave III


In addition to regular sick leave each employee has the following 60% sick leave determined by length of service. All are computed from beginning of sick year.

Less than four (4) years of service 0
From (4) years up to but not including (8) years 15 days
From (8) years up to but not including (14) years 30 days
From (14) years up to but not including (20) years 60 days
(20) years or more 90 days

60% days are not accumulative.

You must be absent without sick time for more than 9 days to be eligible - an employee must be eligible for 12 sick days in previous sick leave year. Employee may request to use AVA or vacation balances before applying for 60% sick leave. If towards end of vacation year sick leave will be interrupted to pay balance of vacation time.

Sick leave II


New employees are not paid first day sick until they reach their first anniversary. If they are placed on the sick abuse list or absentee control list they lose first day sick pay until they come off.

Employee must call in sick at least one hour before commencement of tour. If he fails to do so he is late sick - loss of pay for day. Sick forms must be turned in within three (3) days after return to work. If more than three (3) days then medical proof is required. No sick leave granted due to indulgence of alcohol.

Employee must give notice as to change of location if this cannot be done during time frame then it must be done when circumstances permit. If employee is not on sick abuse he/she does not have to call. 

Employee must give notification at least one hour before return to work for any subsequent tour.

No sick leave granted for less than ¼ of a day.
Work 0 - 59 minutes charged 1 full day.
Work 1 hour to 2 hours 59 minutes charged ¾ day.
Work 3 hours to 4 hours 59 minutes charged ½ day.
Work 5 hours or more charged ¼ day.

If you work first half of run meal period then it is considered work time for computing time worked. No sick leave granted if you are unfit for work because of an accident/injury incurred while working for another employer.

Retirement sick bonus


When an employee retires he will be paid for half of his sick balance. He must have at least half of his potential sick leave. Potential sick leave is computed as in the example of the sick leave previously described.

Advance days are deducted.
Example: employee retires in October - since sick days are given in advance, days for October (if he works less than half month), November, December, January, February, March and April are deducted.

Sick leave I


The sick year begins on May 1st

New employees earn one sick day for each month of employment provided they work the better part of the month (at least half). Sick time is given in advance - every May 1st each employee is given twelve (12) sick days which are accruable.

When a new employee reaches his first anniversary, appointment date he/she is given the balance of that years sick day (prorated). Every May 1st after this he gets 12 days per year. These days are not guaranteed. For leaves of absence without pay, sick days will be deducted.

Example: employee hired June 17th 2011 - what is his/her potential sick balance as of November 2013?

Terminal vacations


Terminal vacation is vacation that is earned for next year that is used this year (retirement, resignation etc)

It is earned at the same rate as regular vacation (for full month work)

Less than three (3) years - one day per full month worked
Over three (3) years - two (2) days per full month worked
Over 15 years - two and half (2½) days per full month worked

Terminal vacation pay on any holiday - run pay - no AVA accrual & no extra eight (8) hours pay.

Vacations


The vacation year begins January 1st. New employee in their first year they earn1 vacation day for each full month worked (maximum of 10 days). Vacation is earned for the following years vacation.

Employees earn two (2) vacations week for their first three (3) vacation years. 
After three (3) full vacation years (January 1st) earns four (4) weeks.
After fifteen (15) full vacation years (January 1st) earns five (5) weeks.

Less than three (3) years - earns one (1) day per month.
More than three (3) but less than fifteen (15) earns two (2) days per month.
Fifteen (15) or more - earn two an half (2½) days per month.

Vacation time is not earned if an employee is on a leave of absence, sick unpaid, suspended, awol etc, any unpaid absence.

Military leave is counted as active employment time. 

It is earned on a maximum of any ten (10) out of twelve (12) months during the year.    

Any leave of absence or break in service less than one (1) year will not be considered an interruption of employment, except when an employee leaves the employment of Transit. He/she is considered a new employee.

Employee get run pay for vacation.

Extra list employee get run pay for vacation days if hold down.

Extra list employee get division pay if floating (work assigned daily)

Vacation time is not accruable and cannot be carried over to the following year.

Vacation pay on pick holiday - eight (8) hours (accrue or eight 8 hours extra pay)

Vacation on non pick holiday - run pay (accrue or eight 8 hours extra pay)

Bonus pay holidays


On four (4) holidays employees are paid a bonus premium of $2.00 dollars per hour. This is paid on the work time of the run only.

The holidays are:
New Years day
Independence day
Thanksgiving
Christmas


Birthday
Your birthday is treated as any other non pick holiday, however a new employee cannot earn a birthday holiday allowance until his first anniversary. In other words he must have one full year as employee from his date of appointment.

Memorial day and Veterans day
Paid to to veterans regardless of length of service.

New employee required to work on a holiday gets 1½ time for the day.

Employees can save eight (8) holidays in the bank per year, after that they are paid. Maximum holiday accrual is eight (8) after that they are paid. Accrued holidays can be carried over to the following year. In order to accrue a holiday employee must give notice in writing. When multiple holidays occur on same day (birthday) both are treated individually. Both can be accrued or paid. Only six (6) holidays can be accrued per calendar year after six (6) all are paid (even if you use them).

Personal day

Each January 1st each employee will be granted a personal leave day. Personal day is eight (8) hours pay. Employee will not get personal day until he has one full year of employment (from January 1st to january 1st). Personal days cannot be carried over to the following year must be used or guaranteed by December 15th. First personal day is guaranteed off (except on holiday).

Leave of Absence - Holidays


A new employee must work thirty (30) days to be entitled to a holiday allowance conversely if an employee is absent for thirty (30) days (sick, LOA etc) he loses holiday allowance (compensation never gets holiday).

Pick holiday A holiday where a pick of runs (Saturday or Sunday schedule) is conducted to replace the regular weekday schedule. Employees on vacation on a pick holiday get eight (8) hours pay for the day.

Employees who pick to work get the pay for the run they work plus an additional eight (8) hours holiday pay or can accrue the day (must submit the accrue form to save days).

Night differential for pick holiday is paid as a regular weekday.

  • Regular weekday runs do not operate on this day.

Non pick holiday on a non pick holiday all regular weekday scheduled runs are operated. Employees can get eight (8) hours additional pay or accrue day.

Employees on vacation get run for the day.

Employees going sick get eight (8) hours pay for the day (all holidays including birthday)

  3. when 10% of the regular runs on the line are open (at least 2)
