Federal Law
H.R. 3590 Enrolled, section 1001 (adding section 2714 to the Public Health Service Act): "A group health plan and a health insurance issuer offering group or individual health insurance coverage that provides dependent coverage of children shall continue to make such coverage available for an adult child (who is not married) until the child turns 26 years of age."
New York State Law
___________
Introduced by Sen. BRESLIN -- (at request of the Governor) -- read twice and ordered printed, and when printed to be committed to the Committee on Rules
AN ACT to amend the insurance law, in relation to the provision of health insurance coverage to the unmarried child of an insured through the age of twenty-nine years
Now there is no excuse because the laws have been enacted at the federal and State level and many members of Local 100 who have adult children that don’t have any coverage feel wronged by Samuelsen. Samuelsen has failed to champion this cause.
This is a win-win situation for Samuelsen and TBOU because if he can get the employer to comply with either law that will allows young adults to continue health coverage under their parents group insurance policy up to the age of 29. This would be possible since the coverage provided to the young adult would be the same as coverage provided to the employee - in this case the parent.
There is cause for concern that Samuelsen may not be interested in this issue and that will only reveal more dissatisfaction from the membership and a lack of trust in his leadership. We offer the analogy of the New York Mets, which just deep sixed their manager and general manager after yet another losing season. Samuelsen has had a worse season than even the Mets and deserves the same fate as Omar Minaya and Jerry Manuel. There is much more at stake than just a game: the future of our membership’s well being and Local 100 is on the line.
