The executive board of Local 100 has turned into a dysfunctional body in their objective to give a fair trial to Israel Rivera Jr. It has turned into a quagmire and it appears that there is no decisive, clear, level headed members to accomplish the task at hand.

Since the trial has been adjourned to monday October 25, 2010, we would recommend for the executive board members to have a spine and do their duty. Maybe during the weekend they should buy Margaret Thatcher books such as: a) The Downing Street Years b) There is no alternative.  Maybe those books will inspire those executive members to act decisively. Maybe those executive board members have given up their full responsibility easily and absolved themselves of their duty. If so then the general membership can replace the executive board and act decisively. We here in why did you join the union would like to know what assurances or guarantees there are that the executive board will act and not give way to uphold their power and responsibilities to the union.

We would like to take this opportunity to remind those executive board members of the 

New York State Labor Law  Section 725  subsection 1.....Any member of such labor organization shall have the right to bring such action or proceeding if (a) after request by any member that such action or proceeding be brought, such organization shall fail to do so, or (b) such request would be futile, or (c) such organization has failed to prosecute diligently any such action or proceeding which it has brought.

The task at hand is Israel Rivera Jr’s misdeeds that have to be decided initially and deposed afterwards. Also if there is any basis to discuss the tangent issues of bad standing, and the elected members qualification based on the dues. Imagine tug boats each pulling in a different direction then the ship will never advance forward it will be stranded and stand still. So we will remind the executive board members of subsection (c) they have to prosecute diligently - the state legislative intended the meaning of the word diligently to show that they care about the general membership.

KISS stands for Keep It Simple Stupid, everyone is aware that Samuelsen may not be able to get reelected without the second position held by a Mabstoa. That is the fact that Israel Rivera Jr is banking on to poison the well by bamboozling the trial into a different direction. However there are many Mabstoa members who are in good standing and honorable people. Samuelsen should apologize to the general membership for picking Israel Rivera Jr because he has no backing in Mabstoa.

We recommend to the executive board to make a clean break and stop wasting time. Israel Rivera Jr has to be removed from the position of the secretary treasurer, disqualified from the membership of the TWU Local 100 and forward the file to the Manhattan or Bronx District Attorneys as soon as possible.
