We here in why did you join the union urge the executive board of Local 100 to forward this matter to the Manhattan District Attorney. Any reasonable member of his peers would find that Israel Rivera Jr has violated New York State Labor Law.
Section 720 - abused their positions of fiduciary responsibility - guilty
subsection 1. Have or acquire any pecuniary or personal interest - guilty
subsection 2. Engage in any business or financial transaction which conflicts with his fiduciary obligation - guilty
subsection 3. Act in any way which subordinates the interest of such labor organization to his own pecuniary or personal interests - guilty
Section 723 and all its subsection - guilty
Warning for executive board we hope you are aware of New York State Labor Law
subsection 1.....Any member of such labor organization shall have the right to bring such action or proceeding if (a) after request by any member that such action or proceeding be brought, such organization shall fail to do so, or (b) such request would be futile, or (c) such organization has failed to prosecute diligently any such action or proceeding which it has brought
Warning and caution
We hope that Samuelsen and the executive board does not falter on this issue, or try to sweep it under the rug due to the fact that New York State Labor Law has given the right to every member of Local 100 to bring action. If the executive board wants to give Israel Rivera Jr a pass we here in why did you join the union, would initiate legal action against both.
